Acceptance of these terms

These Terms of Use (“Terms”) are an agreement between you and Static State (“Static State,” “we,” “us,” or “our”). They apply when you access or use the official Static State website, including staticstate.dev, its temporary Cloudflare Pages address, and related website features.

By using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website.

Eligibility and account responsibility

You must be legally capable of agreeing to these Terms. To use Discord login, you must also meet Discord’s minimum age requirements and any higher age required by the law where you live.

You are responsible for maintaining the security of your Discord account and for activity performed through an authenticated session. Notify Static State if you reasonably believe the website is displaying your account without authorization.

Discord login and community status

Discord login is optional. It may be used to display your Discord identity, whether you have joined the Static State Discord server, and your highest recognized community role.

• Displayed roles are informational and may update, change, or be removed.
• Role information may not refresh instantly.
• A displayed role does not create employment, agency, partnership, ownership, compensation, or contractual rights.
• Logging in or joining the server does not guarantee game access, playtest access, subscriptions, rewards, or permanent community privileges.
• Discord server participation remains subject to Discord’s rules and any Static State community rules.

Static State may suspend website account features or community access when reasonably necessary for security, abuse prevention, rule enforcement, legal compliance, or service operation.

Acceptable use

You may not use the website to:

• Break applicable law or encourage unlawful activity.
• Impersonate Static State, its staff, another user, or another organization.
• Attempt to bypass authentication, role checks, access controls, or security measures.
• Probe, scan, exploit, overload, disrupt, or damage the website or its infrastructure.
• Use automated scraping or extraction in a way that creates unreasonable load or violates applicable rights.
• Introduce malware, malicious code, fraudulent redirects, or deceptive content.
• Copy, republish, or commercially exploit protected website or game assets without permission.

Reasonable linking, normal browser access, commentary, criticism, journalism, and legally protected fair use are not prohibited by this section.

Ownership and permitted use

The website, Static State name and branding, original text, visual design, software, trailers, game materials, and project assets are owned by Static State or used with permission, except for third-party trademarks and materials belonging to their respective owners.

Static State grants you a limited, revocable, non-exclusive, non-transferable permission to access the website for personal, informational, and non-commercial use. No ownership rights are transferred to you.

“Discord,” “Steam,” “YouTube,” “Cloudflare,” and other third-party names and marks belong to their respective owners. Their appearance does not imply sponsorship unless expressly stated.

Games, Early Access, and project information

Website information about NODE ZERO or any other project may describe work in progress. Features, content, screenshots, release windows, platforms, prices, roadmaps, system requirements, availability, and other plans may change, be delayed, or be cancelled.

Pre-release statements are provided for information and are not guarantees. Purchases, licenses, refunds, Early Access participation, and platform-specific services are governed by the terms presented by the applicable storefront or distributor at the time of the transaction.

Third-party services and links

The website may use or link to Discord, YouTube, Steam, Cloudflare, and other third-party services. Static State does not control those services and is not responsible for their availability, security, content, policies, or actions.

Your use of a third-party service is governed by that service’s own terms, privacy policy, and account rules.

Changes, availability, and termination

Static State may modify, suspend, discontinue, restrict, or replace any part of the website at any time. We do not promise that the website, login system, external links, files, or community-status features will always be available, error-free, secure, or compatible with every device.

We may restrict access when reasonably necessary to protect the website, users, Static State, third parties, or legal rights. Sections that by their nature should survive termination will remain effective, including ownership, disclaimers, liability limits, and governing law.

Disclaimers

To the maximum extent permitted by law, the website is provided “as is” and “as available.” Static State disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and freedom from harmful components.

Nothing on the website is legal, financial, medical, or other professional advice. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Static State will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; or damages arising from third-party services, unauthorized access, service interruption, or reliance on pre-release information.

Where liability cannot be excluded, Static State’s total liability arising from the website will not exceed the greater of the amount you paid directly to Static State for use of this website during the six months before the claim or USD $25. The website currently does not charge users for access.

Some jurisdictions do not allow certain limits of liability, so the limits above apply only to the extent permitted by law.

Governing law

These Terms are governed by the laws of the State of Indiana and applicable United States federal law, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought in a court with proper jurisdiction in Indiana, unless applicable consumer law requires otherwise.

General terms

• If any provision is unenforceable, the remaining provisions remain in effect.
• A failure to enforce a provision is not a waiver of that provision.
• You may not transfer your rights under these Terms without written permission from Static State.
• Static State may update these Terms by posting a revised version with a new “Last updated” date.
• These Terms and the Privacy Policy are the entire agreement concerning use of this website.
